What do we use your data for? Purpose of the processing of your data
The information you provide to us is processed for the purposes inherent to professional commercial activity and its proper representation, and the defence of the professional rights and interests of our customers; and specifically for:
- Study, design and preparation of commercial offers relating to the products offered.

Why do we use your data? Legal basis for the processing of your data
Below we explain which legal basis entitles Foncal to process, retain and use your personal data for each of the purposes described above, in accordance with Article 6 of Regulation (EU) 2016/679 (GDPR):

- Handle enquiries, complaints or claims made through the communication channels provided, including email (performance of the contractual relationship / legitimate interest).
Where the processing is based on Foncal’s legitimate interest, such interest consists of being able to develop, maintain and improve its commercial activity and its relationship with its customers, without this disproportionately affecting your rights and freedoms as a data subject, in particular your right to the protection of personal data.

What data do we use?
In providing the services we offer in order to carry out our activity, Foncal may use the following categories of personal data:
- Identification data: first name and surnames, language, country from which you interact with us, address and contact details, among others.
- Financial and transactional information, such as payment or card details, as well as information relating to purchases, orders, returns or incidents.
- Connection, browsing and, where applicable, geolocation data, such as approximate location data, device identifiers or advertising identifiers.
- Commercial information, such as data relating to subscription to our newsletter or to the receipt of commercial communications.
- Data on tastes, preferences and consumption habits relating to our products and services.
How long will Foncal retain your personal data? Retention
Depending on the type of data used and processed:
- User registration. We will process your data for as long as you remain a registered user or, where applicable, until you exercise your right to cancellation/erasure (that is, until you decide to delete your online account or your shop profile).
- Sale and/or service contract. We will process your personal data for the time necessary to manage the purchase of the products or services, including the processing of orders and any returns, complaints or claims relating to the specific purchase. In certain cases, the data will be processed only for as long as you so decide, as is the case, for example, with payment details that you ask us to retain in order to facilitate future purchases, provided that this functionality is available.
- Customer service. We will process your personal data for the time necessary to handle your request, claim, complaint or any other petition made to this company.
- Marketing. We will process your personal data for as long as you remain subscribed to the newsletter.
- Promotions or prize draws. If you take part in promotional activities, we will retain your data for a period of six (6) months from the end of the activity.
- Other cases. We will process your personal data for the time strictly necessary to pursue a duly justified legitimate interest linked to a specific purpose.
In any event, once the relationship with the user has ended, Foncal will retain the data, duly blocked, for the limitation periods of any legal obligations that may arise from the processing.
To whom will we disclose your data? Recipients
As a general rule, we will not disclose your personal data to third parties unless we are required to do so by law or you have given your unequivocal, clear and express consent. Nor will there be any international transfers of data.
In any event, Foncal may disclose or transfer data to:
- Financial institutions, for the management of collections, payments and refunds.
- Entities specialising in fraud detection and prevention.
- Technology, IT and analytics service providers.
- Providers and partners of logistics, transport and product delivery services, as well as, where applicable, their associated establishments.
- Providers of customer service-related services.
- Providers and partners of marketing and advertising services, such as advertising agencies, advertising partners or social networks, which will act as processors in accordance with Article 28 of the GDPR.
Likewise, data may be disclosed to manufacturers and or to their national representatives where necessary for the management and coverage of the warranties of the products manufactured.
In the event of non-payment, data may be disclosed to common credit information systems or financial solvency files, under the terms provided for in the legislation in force.
Finally, data may be disclosed to any other entity where such disclosure is mandatory or covered by the legislation applicable at any given time.
What are your rights when you provide us with your personal data? Where can you exercise them? Rights
Any customer has the right to obtain confirmation as to whether or not Foncal is processing personal data concerning them.
Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where applicable, to request its erasure where, among other reasons, the data are no longer necessary for the purposes for which they were collected.
In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we will retain it solely for the exercise or defence of claims.
You may request the restriction of processing in the following cases:
- While the contested accuracy of your data is being verified.
- Where the processing is unlawful but you oppose the erasure of the data.
- Where Foncal no longer needs to process your data but you need them for the exercise or defence of your claims.
- Where you have objected to the processing of your data for the performance of a task carried out in the public interest or for the purposes of a legitimate interest, while it is being verified whether the legitimate grounds for the processing override yours.
- In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data.
- Foncal will stop processing the data, except for legitimate reasons or the exercise or defence of possible claims.
We draw your attention to your right to withdraw, at any time, the consent given for the processing of your data, without this affecting the lawfulness of processing based on consent before its withdrawal.
Finally, as required by law, we remind you of your right to lodge a complaint with the Spanish Data Protection Agency (AEPD) (https://www.aepd.es/) if you consider that the processing of data does not comply with European legislation.
- You may exercise your rights, providing proof of your identity (photocopy of your DNI, the Spanish national identity document), by sending an email to: administracion@foncal.es. You may withdraw the consent given at any time, without this affecting the lawfulness of the processing, by sending your request to the aforementioned address or by visiting Foncal’s premises. Please remember to enclose your DNI or an equivalent document proving your identity with your request.
